Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Property Tax Strategies ("Company," "we," "us," or "our"), concerning your access to and use of our services including the website at https://realproptax.net as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the services and you must discontinue use immediately.

1. Services Provided

What we offer to our clients

Property Tax Strategies provides property tax protest and consultation services for property owners in the State of Texas. Our services include but are not limited to:

  • Property tax assessment analysis and review
  • Preparation and filing of property tax protests with appraisal districts
  • Representation at informal and formal appraisal review board hearings
  • Consultation and advice regarding property tax matters
  • Portfolio management for multiple properties

We operate on a contingency fee basis for residential properties, meaning you only pay if we achieve tax savings. Commercial properties may be subject to different fee arrangements as outlined in separate service agreements.

2. Client Responsibilities

Your obligations when using our services

To enable us to provide effective representation, you agree to:

  • Provide accurate and complete information about your property and ownership
  • Sign required authorization forms granting us authority to represent you before appraisal districts
  • Respond promptly to our requests for information or documentation
  • Notify us immediately of any changes to property ownership or contact information
  • Review and approve protest strategies and settlement recommendations in a timely manner
  • Pay agreed-upon fees according to the payment terms outlined in your service agreement

3. Fees and Payment Terms

Understanding our pricing structure

Residential Properties

For residential homestead properties, we work on a contingency fee basis. Our fee is a percentage of the first year's tax savings achieved through our protest efforts. If we do not reduce your property taxes, you owe nothing.

Commercial Properties

Commercial property fee structures vary based on property type, value, and complexity. Specific fee arrangements will be detailed in your individual service agreement.

Payment Terms

Fees are due within 30 days of invoice. Payment can be made via check, ACH transfer, or credit card. Late payments may be subject to a 1.5% monthly finance charge.

4. Limitation of Liability

Important disclaimers and limitations

While we work diligently to achieve the best possible outcome for every client, we cannot guarantee specific results. Property tax protests involve subjective valuations and decisions by appraisal review boards over which we have no direct control.

To the fullest extent permitted by law, Property Tax Strategies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability to you for all claims arising from or related to our services shall not exceed the total fees paid by you to us in the twelve months preceding the claim.

5. Termination

How this agreement can be ended

Either party may terminate this agreement with written notice. If you terminate after we have begun work on your protest:

  • For contingency fee arrangements: you will owe fees for any tax savings achieved prior to termination
  • For flat fee or hourly arrangements: you will owe payment for services rendered through the termination date

We reserve the right to terminate representation if you fail to provide necessary information, fail to pay fees when due, or engage in conduct that we determine to be inappropriate or detrimental to our representation.

6. Intellectual Property Rights

Ownership of content and materials

All content on our website, including text, graphics, logos, images, and software, is the property of Property Tax Strategies or its content suppliers and is protected by United States and international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of our content without prior written consent.

7. Privacy and Data Protection

How we handle your information

We take the privacy and security of your personal information seriously. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to our collection, use, and disclosure of your information as described in our Privacy Policy.

8. Governing Law and Dispute Resolution

Legal jurisdiction and dispute handling

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Texas, and the parties hereby consent to personal jurisdiction and venue therein.

Prior to filing any lawsuit, the parties agree to attempt to resolve disputes through good faith negotiation. If negotiation is unsuccessful, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association.

9. Modifications to Terms

How and when we may update these terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of our services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

11. Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

No waiver by us of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

12. Entire Agreement

These Terms of Service, together with our Privacy Policy and any individual service agreements, constitute the sole and entire agreement between you and Property Tax Strategies regarding our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

By using our services, you acknowledge that you have read and understood these Terms of Service and agree to be bound by them.
